Length of time: Lifetime for author + 70 years or company has 100 years.
The law is not about how you got it or how you use it, but it is whether you have permission to use it.
Fair use: parody, news, teaching, critical comment
How it's used (the four above) and the % that is used and does it impede the original creator from making money.
Fair use is a legal defensible decision. For teachers, if you can NOT teach a lesson without using a piece of copyright information, then it might fall under fair use.
